Boat DNa 90152 from the central city of DaNang during its regular operation in its traditional fishing ground wasdeliberately encircled by 40 fishing vessels of China before it was attacked bythe Chinese ship 11209.

The incident occurred at 4 pm at a site 17nautical miles from where China ’s Haiyang Shiyou-981 oil rig is illegallystanding.

Thelocation is the traditional fishing ground of Vietnamese fishermen in Vietnam’s exclusive economic zone and continental shelf.

This is not the first time Vietnamese fishingboats have been attacked by Chinese ships.

On May 16, boat QNg 90205-TS’s regularoperation in the traditional fishing ground in Hoang Sa (Paracel) archipelagowas disrupted by Chinese ship coded 306. Vietnamese fishermen were then beatenby crew members of the Chinese ship while their properties including satellitepositioning and communications equipment were taken away.

After being assailed, the boat, captained byNguyen Van Quang from Binh Son district, central Quang Ngai province, managedto escape and then get medical assistance from Vietnam ’s coast guard vessels.

Quang said the attack cost him about 500million VND (23,500 USD).

On May 7, fishing boat QNg 96416-TS,captained and owned by Nguyen Van Loc from An Vinh commune, Ly Son district,Quang Ngai province, was chased and rammed by a Chinese ship in the Hoang Saarea, suffering from damage to its sides and cabin.

Since the beginning of May, China illegallydispatched the rig, as well as a large fleet of armed vessels, military shipsand aircraft, to Vietnamese waters and positioned the rig at a location 80miles deep inside Vietnam ’s continental shelf and exclusive economic zoneprescribed by the 1982 United Nations Convention on the Law of the Sea (UNCLOS1982).

There are by Chineseaccount 30 Vietnamese rigs drilling in the disputed water of South China Seacontributing a significant portion to Vietnam's GDP. Like I said elsewhere, the only islandsdefinied under UNCLOS that is entitled to an EEZ of their own in the SouthChina Sea is the Woody & Lincoln island of Paracel and Taipingisland of Spratly. Fortunately, they are all in Chinese hand, Taiping beingunder ROC control. Drawing EEZ from these islands can pretty much encompass the9 dash line, except for the southern tips of the Spratly chain. So even byUNCLOS, China has a legitimate claim there. Of course since China neverratified UNCLOS and since the 9 dash line predates that of the UNCLOS, Chinahas more options in asserting its claim. Regardless of which options Chinacalls for, as disputed water, China certainly can stop others picking fruitfrom what it consider as its garden.

Obviously the Chinese government find it moreadvantagous to deal with individual states in the dispute rather than theinternational court. After all, the judgement from the past shows that it allcomes down to actual control of the islands, and while China holds all theright card in the Paracel dispute, the Spratly island dispute however is farmore unpredictable. While none of the island Philippine & Vietnam holds areentitled to it's EEZ, it is the ownership over islands that's of more concernto China rather than the EEZ. Since Vietnam only so far threaten to submit itscase to the international court, we won't know the detail, but if the Paracelisland dispute can be isolated from the others, I think China should sieze theopportunity to settle that in the international court, abeit waiting another 15years for the 50 year mark would help further China's case. For now, Chinawould wait, and see if Vietnam does follow through with its threat.
显然中国政府发现分别解决争端更有利，而不是国际法庭。毕竟从过去的判决来看归根结底都是看岛屿的实际控制，而中国西沙争端中握了一手好牌，南沙争端则是更加不可预计。而菲律宾和越南掌握的岛屿都没有资格声明专属经济区，中国更加关注岛屿的所有权而不是专属经济区。因为越南目前为止仅仅是威胁要告上国际法庭，我们不知道细节，但是如果西沙争端可以从其他关系中独立出来，我认为会抓住机会在国际法庭上解决问题的，即使在等15年到达50年，对中国的案子更加有力，中国会等待，看看是否越南会彻底实施他们的恐吓。
